SC court nixes James Brown estate settlement

COLUMBIA, S.C. (AP) ? The South Carolina Supreme Court on Wednesday overturned a settlement divvying up the multimillion-dollar estate of James Brown, saying a former attorney general didn't follow the late soul singer's wishes in putting together the deal.

Attorney General Henry McMaster brokered a settlement in 2009 that split Brown's estate, giving nearly half to a charitable trust, a quarter to his widow, Tomi Rae Hynie, and leaving the rest to be split among his adult children.

But the justices ruled that the deal ignored Brown's wishes for most of his money to go to charity. The court also ruled the Godfather of Soul was of sound mind when he made his will before dying of heart failure on Christmas Day 2006 at age 73.

The court sent the estate back to a lower court to be reconsidered.

The justices did agree with the lower court's decision to remove Brown's original trustees. Members of Brown's family said they wanted them gone because the trustees mismanaged the estate until it was almost broke.

The court said it had no idea what the estate was worth, giving an estimate of $5 million to more than $100 million.

The justices harshly criticized McMaster, who stepped in to broker the settlement after the estate floundered in court for years. Under McMaster's deal, a professional manager took control of Brown's assets from the estate's trustees, wiping out crushing debt ? more than $20 million Brown had borrowed for a European comeback tour ? and opening the way for needy students to receive college scholarships. The plan allowed a financial manager to cut lucrative deals that put Brown's music on national and international commercials for products such as Chanel perfume and Gatorade.

Chief Justice Jean Toal suggested Wednesday that, if the settlement was allowed to stand, it could discourage people from leaving most of their estate to charity for fear their wishes could easily be overturned.

The dispute came to the court after the ousted trustees sued.

"The compromise orchestrated by the AG in this case destroys the estate plan Brown had established in favor of an arrangement overseen virtually exclusively by the AG," giving large sums of money to relatives even though they were given little or no control in the singer's original will, Associate Justice John Kittredge wrote.

The fight over Brown's estate even spilled over into what to do with his body. Family members fought over the remains for more than two months, leaving Brown's body, still inside a gold casket, sitting in cold storage in a funeral home. Brown was eventually buried in Beech Island, S.C., at the home of one of his daughters. The family wanted to turn the home into a shrine for Brown similar to Elvis Presley's Graceland, but that idea has not gotten off the ground.

An attorney for Adele Pope ? one of the trustees who appealed ? commended the court for its ruling, which he said would more accurately fulfill Brown's wishes.

"James Brown was certainly devoted to the cause of education," James Richardson said. "Today's decision means that the bulk of his fortune will go to the cause of educating needy children."

McMaster, who left office in 2010, did not immediately comment on the ruling. However, he said in 2011 that "the settlement was a very good one for ... the education of the poor children, because there was a danger that they would get nothing."

Current Attorney General Alan Wilson said he respected the court's decision but felt McMaster had acted legally.

Excess or Umbrella? - Loftis & Wetzel Corporation


In 2009 a jury in Hernando County, Florida, rendered a verdict of just more than $330 million to the family of a 13-year old girl who was tragically killed in a car accident caused by a drunk driver.

Large verdicts are becoming increasingly common. While of course no one is condoning drunk driving?and legitimate arguments can be made about the price tag on a human life?the point is that the average cost of claims against negligent parties is rising at an alarming rate. According to the National Law Journal, premises liability awards increased 16.4 percent to an average of $242,782 in 2009. In that same year, motor vehicle awards jumped almost 40 percent to an average of $48,480 and wrongful death claims averaged $2,185,000.

These numbers should serve as a reminder that liability limits provided by home, auto and other insurance policies should be carefully reviewed. And this review should prompt the question: Are the limits high enough to protect your family?s financial well-being and way of life if a claim is made against you?

Unfortunately there is no definite answer to that question. But if the statistics above make the opportunity to purchase more liability insurance coverage appealing to you, it?s important to consider your options. Two common choices are excess liability insurance and a personal umbrella policy.?? ?

Umbrella vs. Excess
If you have increased the liability limits of your home, auto or other insurance policy to as high as your company will offer and still are not comfortable, you have two options. The first is typically called an excess liability policy. This policy does nothing to the terms of your other insurance policies - it simply raises the limit of liability you have available for a claim. Think of this policy as dollars held in reserve if a claim exceeds the limits you currently have available.

A second option is a personal umbrella policy. Most umbrella policies function as an excess liability policy. However, in addition to acting as a reserve, the umbrella provides additional coverage for types of losses that otherwise would not be paid. Examples of additional coverage may include:

? Expanding the auto coverage territory to almost anywhere in the world
? Personal injury coverage for claims such as libel or slander
? Liability for certain claims resulting from your role as a director/officer of an organization.

Maintenance of ?Underlying?
The intent of an umbrella policy is to extend limits and coverage on some or all of the insurance policies you currently have. Such policies typically include your homeowners and auto insurance policies and may also include others such as a condo, watercraft or ATV. The policies covered by the umbrella are called ?underlying? policies.

Underlying policies are important because most umbrellas will only cover such a policy if certain rules are met. Examples of such rules typically include the financial strength rating of the insurance company from which you purchased the underlying policy and the limits of insurance included on that policy.

For example, to obtain an umbrella policy, you likely will have to prove that the limits of the underlying policies that it covers (such as your homeowners and auto insurance) are not less than a specified dollar amount. Should you change those limits mid-term, you risk changing the way your umbrella will apply toward a loss.

Say you decide to purchase a $1 million umbrella policy and the umbrella provider specifies that it will cover your homeowner?s policy provided it includes a personal liability limit of at least $300,000. You currently have $300,000 personal liability on your homeowner?s policy and show a copy of it to the umbrella provider as proof. A few months after the umbrella policy takes effect, you call your homeowner?s insurance company and request that your personal liability limit be lowered to $100,000 to lower your premium.

A few weeks later someone suffers a serious injury for which you are legally liable and a claim is filed. Your policy limit of $100,000 is used up but there are still bills to pay. You are certain everything is okay because you have a $1 million umbrella policy. However, since you no longer meet the terms of the agreement, the umbrella provider may not pay a dime until the required minimum of $300,000 has been met. In this case, you would be out-of-pocket for $200,000. This is the difference between your personal liability limit ($100,000) and the required minimum specified by the umbrella provider ($300,000). Some personal umbrella policies may not respond at all once the terms have been breached.

It?s important to remember that excess and umbrella polices differ depending on which insurance company you choose to work with. Understanding how such policies relate to your underlying policies can be tricky. Where did that Russian meteor come from? Astronomers determine origins.

Relying on the many publicly available videos of the meteor that exploded over Russia's Ural Mountains earlier this month, a pair of Colombian astronomers say that they have calculated the space rock's orbit.

Just a week after a huge fireball streaked across the skies of the Chelyabinsk region of Russia, astronomers published?a paper?that reconstructs the orbit and determines the origins of the space rock that exploded about 14-20 km (8-12.5 miles) above Earth?s surface, producing a shockwave that damaged buildings and broke windows.

Researchers Jorge Zuluaga and Ignacio Ferrin at the University of Antioquia in Medellin, Colombia used a resource not always available in meteorite falls: the numerous dashboard and security cameras that captured the huge fireball. Using the trajectories shown in videos posted on YouTube, the researchers were able to calculate the trajectory of the meteorite as it fell to Earth and use it to reconstruct the orbit in space of the meteoroid before its violent encounter with our planet.

The results are preliminary, Zuluaga told Universe Today, and they are already working on getting more precise results. ?We are working hard to produce an updated and more precise reconstruction of the orbit using different pieces of evidence,? he said via email.

But through their calculations, Zuluaga and Ferrin determined the rock originated from the Apollo class of asteroids.

Using triangulation, the researchers used two videos specifically: one from a camera located in the Revolutionary Square in Chelyabinsk and one video recorded in the a nearby city of Korkino, along with the location of a hole in the ice in Lake Chebarkul, 70km west of Chelyabinsk. The hole is thought to have come from the meteorite that fell on February 15.

Zuluaga and Ferrin were inspired to use the videos by Stefen Geens, who writes the?Ogle Earth blog?and who pointed out that the numerous dashcam and security videos may have gathered data about the trajectory and speed of the meteorite. He used this data and Google Earth to reconstruct the path of the rock as it entered the atmosphere and showed that it matched an image of the trajectory taken by the geostationary Meteosat-9 weather satellite.

But due to variations in time and date stamps on several of the videos ? some which differed by several minutes ? they decided to choose two videos from different locations that seemed to be the most reliable.

From triangulation, they were able to determine height, speed and position of the meteorite as it fell to Earth.

But figuring out the meteroid?s orbit around the Sun was more difficult as well as less precise. They needed six critical parameters, all which they had to estimate from the data using Monte Carlo methods to ?calculate the most probable orbital parameters and their dispersion,? they wrote in their paper. Most of the parameters are related to the ?brightening point? ? where the meteorite becomes bright enough to cast a noticeable shadow in the videos. This helped determine the meteorite?s height, elevation and azimuth at the brightening point as well as the longitude, latitude on the Earth?s surface below and also the velocity of the rock.

?According to our estimations, the Chelyabinski meteor started to brighten up when it was between 32 and 47 km up in the atmosphere,? the team wrote. ?The velocity of the body predicted by our analysis was between 13 and 19 km/s (relative to the Earth) which encloses the preferred figure of 18 km/s assumed by other researchers.?

They then used software developed by the US Naval Observatory called NOVAS, the Naval Observatory Vector Astrometry to calculate the likely orbit. They concluded that the Chelyabinsk meteorite is from the Apollo asteroids, a well-known class of rocks that cross Earth?s orbit.

According to?The Technology Review blog, astronomers have seen over 240 Apollo asteroids that are larger than 1 km but believe there must be more than 2,000 others that size.

However, astronomers also estimate there might be about 80 million out there that are about same size as the one that fell over Chelyabinsk: about 15 meters (50 feet) in diameter, with a weight of 7,000 metric tons.

In their ongoing calculations, the research team has decided to make future calculations not using Lake Chebarkul as one of their triangulation points.

?We are acquainted with the skepticism that the holes in the icesheet of the lake have been produced artificially,? Zuluaga told Universe Today via email. ?However I have also read some reports indicating that pieces of the meteoroid have been found in the area. So, we are working hard to produce an updated and more precise reconstruction of the orbit using different pieces of evidence.?

Many have asked why this space rock was not detected before, and Zuluaga said determining why it was missed is one of the goals of their efforts.

?Regretfully knowing the family at which the asteroid belongs is not enough,? he said. ?The question can only be answered having a very precise orbit we can integrate backwards at least 50 years. Once you have an orbit, that orbit can predict the precise position of the body in the sky and then we can look for archive images and see if the asteroid was overlooked. This is our next move!?

Egypt balloon crash kills 19 Asian, European tourists

CAIRO (Reuters) - A hot air balloon crashed near the Egyptian town of Luxor at dawn on Tuesday after a mid-air gas explosion, killing 19 Asian and European tourists, a local industry official and the state news agency said.

Ahmed Aboud, a spokesman for balloon operators in the area, told Reuters that one tourist and the pilot had survived the crash, which followed the blast at 1,000 feet.

The dead were from Britain, France, Japan and Hong Kong, the state news agency MENA reported, citing a security source.

"There were 20 passengers aboard. An explosion happened and 19 passengers died. One tourist and the pilot survived," he said by telephone. Aboud is the representative of eight companies that operate balloon flights in Luxor, near ancient Egyptian sites in the famed Valley of the Kings.

Did you think the Nokia Lumia 620 was a solid enough smartphone to shake up emerging markets, thanks to its low cost? Say hello to the Lumia 520, which at an estimated cost of $183 will be one of the (if not the) least expensive Windows Phone 8 devices once it comes out later this quarter. It's attracted a commitment from T-Mobile in the US (timeframe not yet specified) and other carriers around the world, so we're likely going to see a lot more of this little beaut in the future. Naturally, it's time for a face-to-face introduction.

The Lumia brand as a whole is very consistent in its overall design language, so it's not difficult to tell that the 520 fits perfectly in the lineup. It will be offered in five of Nokia's usual colors: cyan, red, black, yellow and white. If you're interested in swapping covers, snap-on backs will be available -- but beware, the actual back of the device itself isn't removable. The right side of the phone houses three buttons: the volume rocker, power and the dedicated shutter button. A 3.5mm jack sits on top, whereas the micro-USB charger is on the bottom.

While it felt a little cheaper (as one would expect with such a low-end handset), it still seemed to be held together quite solidly. Interestingly, the phone's weight wasn't distributed across the device like we saw on the 720, but instead the middle of the device seemed pretty hollow, even though it held its fair share of circuitry and other components. We've only just stepped into Mozilla's press arena but the Firefox creators handed a rich press kit as we did, detailing a fair chunk of what we're expecting to see over the next hour. One of the more noticeable announcements focused on Firefox Marketplace, detailing HTML5 apps you might have heard of before. Along the predictable likes of Facebook and Twitter, games like Cut The Rope will also make an appearance on the new mobile OS, as well as Where's My Water, Disney Mobile and EA game titles. There will be support for cloud file storage through Box too, as well as a mapping app from Nokia Here. Yes, the Finnish phone maker will be bringing its location clout to Firefox OS. SoundCloud, Pulse News, Time Out and Airbnb have also signed up for the new operating system.

Williams scores 46 to lead New Mexico past CSU

FORT COLLINS, Colo. (AP) -- With 9 minutes left, New Mexico guard Kendall Williams trudged to the bench with a career-high 28 points - and four fouls.

While he caught his breath, No. 22 Colorado State built a six-point lead over the 16th-ranked Lobos.

Moby Arena was rocking and the Rams were rolling, about to extend the nation's third-longest home winning streak to 28 games.

Williams had other things in mind - and 18 points left to score.

"Luckily, some shots went in," said the junior guard from Rancho Cucamonga, Calif., who finished with a career-best 46 points - almost double his previous career high of 24 - in leading New Mexico to a 91-82 win Saturday.

Williams set a Mountain West Conference record with 10 3-pointers and his 46 points were the most in the 47-year-old arena, topping the 44 scored by Portland State's Freeman Williams on Nov. 29, 1975.

"He should be hands-down player of the week, I would think," Lobos coach Steve Alford deadpanned.

Williams helped the Lobos overcome that 70-64 deficit at the 6-minute mark by hitting a trio of 3-pointers, a dunk and seven free throws down the stretch as New Mexico outscored the Rams 27-12.

"He got on a roll today," Alford said. "And it was a 40-minute roll."

Actually, it was a 33-minute roll. He spent seven minutes on the bench in foul trouble.

"That's what's really impressive," Alford said. "He sat about a four-minute stretch there in the second half and still scores and does what he does. It's pretty amazing. But he did a great job in that last six minutes not picking up that fifth" foul.

Center Alex Kirk added 19 points and 10 rebounds for the Lobos (23-4, 10-2), who increased their lead in the conference race to two games over the Rams (21-5, 8-4).

Colton Iverson had 26 points and 15 boards for the Rams, who looked like they were going to move into a first-place tie atop the standings after taking a 70-64 lead at the 6-minute mark.

Williams' treys highlighted a 14-2 run that gave New Mexico a 78-72 lead before the Rams sent the Lobos to the line over the final two minutes.

"Well, that was a special night to watch," Alford said. "I told him that. I said I never had a 10-3 game, I never got to 46. Forty-two was the most I ever scored and eight 3s was the most I ever made in a game."

"There's not too many one-ups you can get on Coach Alford, especially in scoring," Williams said. "I might be on top of the world for the rest of the weekend."

Williams' previous career best was 24 points against Indiana State and New Mexico State earlier this season.

"The players kept feeding me the ball," said Williams, who had 15 family members, including his grandmother, in the stands. "It was really just a team effort, some of the shots I hit were tough. But if the teammates didn't put me in position and the coaches didn't put me in position, I wouldn't have had quite the night I had."

The Rams blamed themselves for Williams' big game.

"We had no answer for him," Rams coach Larry Eustachy said. "... He was completely unstoppable. I want to see film on how many of those shots were contested."

His bet is that not many were.

The Rams, who gave up 45 points to Air Force's Michael Lyons a week earlier, left Williams open early on while locking down Tony Snell, who scored 10 points Saturday after getting 23 in their first meeting last month.

"He hadn't been shooting well this year," Dorian Green said. "We gave him some uncontested looks, let him get hot. Guys are too good in our league to do that."

"We gave him open looks early," Wes Eikmeier added. "He got hot and then he was feeling it the rest of the night."

Green (20) and Eikmeier (22) gave the Rams three 20-point scorers in their losing effort. Eikmeier scored 11 straight to put the Rams ahead 55-50.

The Lobos quieted the crowd with a 12-6 run to regain the lead at 62-61, but Williams, less than a minute after returning to the lineup, was whistled for his fourth foul and took a seat at the nine-minute mark.

"I was real mad," Williams said. "My emotions were high, but (assistant coach Craig) Neal came over while Coach Alford was doing his thing and calmed me down and says, `You're going to have to bring it home, kid. Don't foul and get the shots that you need.' And that's exactly what I did."

The Rams were coming off a two-point loss at UNLV on Wednesday night that snapped their six-game winning streak, which began after a 66-61 loss to the Lobos in Albuquerque last month.

They hadn't lost at home since Nov. 11, 2012, to Southern Miss., which was coached at the time by Eustachy, who took the Rams job last offseason.

Williams' 10th 3-pointer - in 13 tries - broke the conference mark of nine set by several players, most recently UNLV's Chace Stanback against Central Arkansas on Dec. 28, 2011. It was a difficult shot from the right corner.

"Why not? Just throw it up there, had hit a few already," Williams said. "With the hoop the size it was tonight and the rhythm I was feeling, it just felt like I had to throw that one up."

They bailed on mortgage but want to buy again

Home sales are slowly climbing back, thanks to investor demand, improving consumer confidence in housing, and the surprising return of former homeowners who once walked away from their commitments.

These so-called "strategic defaulters," some of them investors and some owner-occupants, are coming back to the market, despite damaged credit, and apparently the market is welcoming them back.

A new survey of past clients by YouWalkAway.com, a website that assists borrowers in the legal pitfalls of strategic default, found that nearly 80 percent expressed a desire to buy a home again within the next 12 months. It also cites data by Moody's analytics, showing that the number of eligible home buyers who have had a previous foreclosure will be 1.5 million by the first quarter of 2014.

Crashing home prices and sketchy mortgage products caused millions of Americans to default on their loans and eventually lose their homes. For some, it was a tragic fight to the end to keep their single largest investment; for others it was a conscious decision to walk away from their mortgage commitments, given the real fact that they would likely not see home equity again for many years to come.

Some saw this as morally reprehensible, others as a sensible business decision.

While home ownership has fallen dramatically since the recent housing boom, from a high of 69.2 percent in 2004 to 65.4 percent at the end of 2012, according to the U.S. Census, the desire to own a home is still strong. About 70 percent of Americans surveyed by online real estate website Trulia.com said homeownership was still a part of the "American Dream." Of those surveyed by Fannie Mae in January of 2013, 65 percent said that if they had to move, they would buy a home, rather than rent.

Coming back to home ownership may not be as difficult as some think. Consumers who only defaulted on their mortgage during the recent recession were far better risks than those who went delinquent on multiple credit accounts, like credit cards and auto loans, according to a 2011 study by TransUnion.

"There appears to be a pocket of opportunity among mortgage-only defaulters that is not the result of excess liquidity, but rather the unique circumstances of the recent recession," said Steve Chaouki, group vice president in TransUnion's financial services business unit in the study release. "This new market segment that the recession created is an important one for lenders to understand. They have the potential, today, to be stronger and more reliable customers."

Not surprisingly, given this potential, YouWalkAway.com is launching the "AfterForeclosure.com Pass/Fail App," which claims to tell potential borrowers in just one minute, "if they have a shot at home ownership."

"We want people to know that it's possible and, in a lot of cases, it's advantageous," says Jon Maddux, former CEO and co-founder of YouWalkAway.com.

It is possible, but mortgage underwriting is far more strict today than during the housing boom, and there are varying waiting periods before former homeowners who went through foreclosure can qualify for a new loan. The Federal Housing Administration, the government insurer of home loans which now backs just over 20 percent of new loan originations, requires a three-year wait. Fannie Mae and Freddie Mac, which own or guarantee the bulk of the remaining new loan originations, require up to seven years for a strategic defaulter to qualify again for a mortgage.

Providence teacher arrested on vacation in Florida with former student

PROVIDENCE, R.I. -- A Providence school teacher is in a Florida jail on accusations that he took a teenage former student to Miami Beach this week without parental permission.

David Jones, 56, was charged by Miami Beach police Thursday with "interference with custody," a third-degree felony in Florida that makes it a crime for someone to take or entice "any minor or any incompetent person" from custody of parents, guardians, or a public agency in charge of the child's care.

Jones appeared in Miami-Dade Court Thursday and ordered held on $9,000 bond, said J. Francois, a clerk at the Miami-Dade jail. She said Friday morning that Jones was still at the jail.

Missouri Dems Propose Bill to Make it a Felony to Limit Union Power

Three Missouri Democrats signed on to a bill that would make it illegal for state legislators to even suggest laws limiting unions? collective bargaining powers.

The legislation was sponsored by Rep. Jeff Roorda. According to the text of the bill, any legislator who proposes restrictions on collective bargaining will be subject to prosecution for a class D felony.

?Any member of the general assembly who proposes a piece of legislation that further restricts the right of an individual to bargain collectively, as set forth under section 29, article I of the Missouri Constitution, shall be guilty of a class D felony,? reads the text of the bill.

The legislation would prevent state congressmen from proposing laws such as right-to-work, a popular labor policy reform that gives individual workers the right not to join unions. Michigan recently became the 24th?right-to-work state in the nation. Missouri does not have right-to-work.

Roorda?s office did not immediately respond to requests for comment. His bill likely came in response to one proposed by Republican Rep. Mike Leara, which would similarly criminalize any efforts by legislators to restrict gun ownership.
